NuWorldLeads Group Pty Ltd complies with applicable data protection and privacy legislation in each jurisdiction, including: the UK GDPR and Data Protection Act 2018 (United Kingdom); the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation (Canada); the Privacy Act 1988 as amended (Australia); and applicable US state privacy laws including the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA).

1. Who We Are

NuWorldLeads is a revenue growth automation infrastructure company. We are operated by NuWorldLeads Group Pty Ltd, incorporated in Australia (ABN 69 702 042 886, ACN 702 042 886). We provide AI-powered revenue growth and client acquisition automation services to professional service businesses through our Revenue Growth Automation Plan (RGAP), Predictive Search Authority (PSA), and Revenue Automation Infrastructure Audit (RAIA) services.

NuWorldLeads Group Pty Ltd acts as the data controller for all personal information collected through nuworldleads.com and through NuWorldLeads client engagements, regardless of the jurisdiction in which the client or individual is located. NuWorldLeads is not registered in the United Kingdom but accepts clients based in the United Kingdom and is subject to UK GDPR obligations in respect of those clients.

2. What Information We Collect

2.1. Information you provide directly

• Business contact information including business name, your name, job title, email address, phone number, and office address, provided through our website enquiry forms, qualification assessments, or direct communication.

• Information provided through the NuWorldLeads qualification and onboarding process including business details, service types, geographic markets, revenue growth targets, and technology currently in use.

• Event and webinar registration information where you register for NuWorldLeads-hosted or co-hosted events, including your name, business name, email address, and any other information provided at registration.

• Communications you send to us by email, phone, WhatsApp, or through our website.

• Payment and billing information provided for the purposes of invoicing and payment processing. Payment card details are processed by Stripe, Inc. NuWorldLeads does not store payment card details directly.

2.2. Information collected automatically

NuWorldLeads uses website visitor identification technology to analyse a visitor’s device IP address and identify the organisation associated with it. We use this information to understand which organisations may be interested in our services and may contact those organisations, or individuals in relevant roles within them, about relevant matters.

• Website usage data including pages visited, time on site, referring URL, browser type, device type, and IP address, collected through standard web analytics tools.

• Website visitor identification data. Where you visit nuworldleads.com, we may use third-party technology to identify the business or organisation associated with your visit based on your IP address and publicly available business data. This identification is at the business level and is used for the purpose of following up with professional service businesses that may benefit from NuWorldLeads services.

• Email engagement data including whether emails sent to you were opened and whether links were clicked. For outbound email campaigns directed at United States recipients, NuWorldLeads uses Instantly, an email outreach platform. Engagement data from those campaigns is collected and retained as described in Section 5.

• Where you interact with NuWorldLeads through WhatsApp Business, message content and engagement data is collected through that platform subject to WhatsApp’s terms and privacy policy.

2.3. Information collected through the delivery of RGAP, PSA, and RAIA services

• Performance data generated through the activation and management of RGAP, PSA, and RAIA services including search performance data, intake conversion data, call data, review and referral data, and website analytics.

• Any client data uploaded to or processed through systems managed by NuWorldLeads on the client’s behalf, subject to the terms of the client’s engagement agreement.

3. How We Use Your Information

NuWorldLeads uses the information we collect for the following purposes:

• To respond to enquiries and assess whether an RGAP, PSA, or RAIA engagement is a suitable fit for your business.

• To deliver, manage, and optimise the RGAP, PSA, and RAIA services you have selected.

• To generate and send invoices and manage payment for services.

• To communicate with you about your engagement, including performance reports, updates, and service notifications.

• To follow up with professional service businesses that have visited nuworldleads.com or registered for NuWorldLeads events and may benefit from our services, where we have a legitimate interest in doing so.

• To send outbound email campaigns to professional service business contacts in the United States, where we have a legitimate interest or where consent has been provided, in compliance with the CAN-SPAM Act.

• To improve our automation solutions, infrastructure, and methodologies using aggregated and anonymised performance data.

• To comply with our legal and regulatory obligations in the jurisdictions in which we operate.

• To protect the rights, property, and safety of NuWorldLeads, our clients, and third parties.

4. Legal Basis for Processing

4.1. United States

We collect and use personal information as described in this policy. We do not sell personal information. We send commercial email in compliance with the CAN-SPAM Act and provide an unsubscribe mechanism in every commercial email. California residents have additional rights under the CCPA and CPRA as described in Section 8.

4.2. Canada

We collect, use, and disclose personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, provincial private-sector privacy legislation including the Personal Information Protection Act (PIPA) in British Columbia and Alberta, and the Act respecting the protection of personal information in the private sector (Law 25) in Quebec. We collect personal information only for purposes that a reasonable person would consider appropriate in the circumstances, and we identify those purposes at or before the time of collection.

4.3. United Kingdom

We process personal data on the following legal bases under the UK GDPR:

• Contract: processing necessary for the performance of our engagement agreement with you.

• Legitimate interests: following up with professional service business contacts who have visited our website, registered for our events, or engaged with our content, where we have assessed that our interests do not override your fundamental rights.

• Legal obligation: processing required to comply with applicable law.

• Consent: where you have provided explicit consent, including for certain marketing communications.

4.4. Australia

We collect, use, and disclose personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth) as amended. We collect personal information that is reasonably necessary for our business functions and activities, and we take reasonable steps to ensure that personal information we collect is accurate, up to date, and complete.

5. Data Retention

We retain personal information for as long as is necessary for the purposes for which it was collected and in accordance with applicable legal requirements. Specific retention periods are as follows:

• Client engagement data: retained for the duration of the engagement and for seven years following termination, in accordance with standard commercial record-keeping requirements.

• Prospecting and enquiry data: retained for up to 24 months from the date of last contact where no engagement has commenced, after which it is deleted or anonymised.

• Event and webinar registration data: retained for up to 24 months from the date of the event.

• Outbound email campaign data (Instantly): retained for up to 24 months from the date of last contact.

• Website analytics data: retained for up to 26 months.

• Financial and invoicing records: retained for the period required by tax and accounting laws in the relevant jurisdiction, typically seven years.

6. Sharing Your Information

NuWorldLeads does not sell personal information. We may share information in the following circumstances:

• With third-party technology providers used to deliver RGAP, PSA, and RAIA services, where those providers are engaged under appropriate data processing agreements and are bound to use data only as directed by NuWorldLeads.

• With Stripe, Inc. for the purpose of processing client payments. Stripe operates as an independent data controller in respect of payment card data. NuWorldLeads does not receive or store full payment card details.

• With Instantly for the purpose of conducting outbound email campaigns directed at United States-based professional service business contacts. Instantly processes contact information and engagement data on our behalf.

• With professional advisors including lawyers, accountants, and auditors, where necessary for the conduct of our business.

• With regulatory authorities or law enforcement agencies where required by law.

• In connection with a business sale, merger, or acquisition, where personal data may be transferred as part of that transaction subject to appropriate confidentiality obligations.

Where data is transferred outside your jurisdiction, for example from the United Kingdom to Australia or the United States, we ensure that appropriate safeguards are in place, including standard contractual clauses approved by the relevant data protection authority or reliance on adequacy decisions where applicable.

7. Security

NuWorldLeads implements appropriate technical and organisational measures to protect personal information against unauthorised access, disclosure, alteration, or destruction. These measures include access controls, encrypted data transmission, and regular security reviews.

No method of transmission over the internet or electronic storage is completely secure. While we take commercially reasonable steps to protect your information, we cannot guarantee absolute security.

In the event of a data breach that is likely to result in a risk to your rights or interests, we will notify you and the relevant regulatory authority as required by applicable law, including under the Notifiable Data Breaches scheme (Australia), the UK GDPR breach notification requirements, and applicable US state breach notification laws.

8.1. United Kingdom residents (UK GDPR)

You have the following rights regarding your personal data:

• Right to rectification: to request correction of inaccurate or incomplete data.

• Right to erasure: to request deletion of your personal data in certain circumstances.

10. Marketing Communications

Where you have provided your business contact details through our website, qualification assessment, event registration, or direct engagement, NuWorldLeads may contact you with information about our services where we have a legitimate interest in doing so or where you have provided consent.

For recipients in the United States, outbound email campaigns are conducted through Instantly in compliance with the CAN-SPAM Act. Every commercial email includes a clear unsubscribe mechanism.

You can opt out of marketing communications at any time by contacting us at [email protected] or by clicking the unsubscribe link in any email we send. Opting out of marketing communications does not affect our ability to contact you regarding an active engagement.

11. Changes to This Policy

NuWorldLeads may update this Privacy Policy from time to time to reflect changes in our practices, technology, or applicable law. We will post the updated policy on our website and, where the changes are material, notify active clients by email with at least 30 days’ notice before the changes take effect.
